1عن هذه الشروط

شروط الخدمة هذه («الشروط») اتفاقية بينك وبين شركة MIDBRA.IN PTY LTD التي تعمل تحت اسم «ميو لابز» («شباب» أو «نحن»)، وهي شركة أسترالية مقرها ملبورن في ولاية فكتوريا. وتسري هذه الشروط على تطبيق شباب وموقعنا الإلكتروني وكل ما نقدمه من خلالهما («الخدمة»).

بإنشائك ملفاً شخصياً أو استخدامك الخدمة، فإنك توافق على هذه الشروط وعلى إرشادات المجتمع وسياسة الخصوصية، وتشكّل جميعها الاتفاقية الكاملة بينك وبيننا. وإذا لم توافق، فلا تستخدم تطبيق شباب.

هذه الشروط مبرمة بينك وبيننا فقط، وليست مع شركة Apple Inc. ونحن، وليس Apple، المسؤولون وحدنا عن تطبيق شباب ومحتواه.

2من يحق له استخدام تطبيق شباب

تطبيق شباب للتواصل الاجتماعي مصمَّم للرجال من عمر 18 عاماً فما فوق. ولاستخدامه يجب عليك:

• أن يكون عمرك 18 عاماً على الأقل، وأن تكون أهلاً لإبرام عقد ملزم؛
• أن تستخدم وجهك الحقيقي في صورة ملفك الشخصي؛
• ألا يكون لديك سوى ملف شخصي واحد، وألا نكون قد أزلنا ملفاً شخصياً لك من قبل؛
• ألا تكون موجوداً في دولة تخضع لحظر تفرضه حكومة الولايات المتحدة، أو صنّفتها حكومة الولايات المتحدة دولةً «داعمة للإرهاب»، وألا يكون اسمك مدرجاً في أي قائمة لحكومة الولايات المتحدة للأطراف المحظورة أو المقيّدة؛
• أن تلتزم بجميع القوانين التي تنطبق عليك، ومنها أنظمة المملكة العربية السعودية أثناء وجودك فيها.

يجوز لنا أن نطلب منك تأكيد عمرك، أو تأكيد أن الصورة صورتك فعلاً، ويجوز لنا رفض أي ملف شخصي لا يستوفي هذه المتطلبات أو إيقافه أو إزالته.

وباستخدامك تطبيق شباب، فإنك تقرّ وتضمن أنك تستوفي جميع هذه المتطلبات.

3ملفك الشخصي

• يجب أن يكون كل ما في ملفك صحيحاً وخاصاً بك.
• أنت مسؤول عن كل ما يحدث في ملفك، وعن حماية جهازك وحساب Apple الخاص بك.
• لا يطلب تطبيق شباب بريداً إلكترونياً أو رقم هاتف، ولذلك يرتبط ملفك بالجهاز الذي تستخدمه. وإذا حذفت التطبيق، أو أعدت ضبط جهازك أو فقدته، فقد تفقد ملفك، وقد لا نتمكن من استعادته.
• لا يجوز لك بيع ملفك أو نقله أو مشاركته.

4عدم التسامح إطلاقاً

لا يتسامح تطبيق شباب إطلاقاً مع المحتوى المسيء أو الأعضاء المسيئين، ويجب عليك الالتزام بـإرشادات المجتمع في كل الأوقات. وهي تحظر، من بين أمور أخرى، العري والمحتوى الجنسي والطلبات الجنسية والتحرش والكراهية والتهديد والاحتيال والسلع غير المشروعة وأي شيء يتعلق بشخص دون 18 عاماً. وقد تؤدي مخالفتها إلى إزالة محتواك أو ملفك دون إشعار.

5الإبلاغ والحظر والإشراف

• يمكنك الإبلاغ عن أي ملف شخصي أو محادثة عبر «إبلاغ»، وحظر أي شخص عبر «حظر». والبلاغات سرّية: لا نخبر أي عضو بمن أبلغ عنه.
• قد نستخدم أدوات آلية ومراجعة بشرية لتصفية المحتوى المخالف لهذه الشروط ورصده واتخاذ الإجراء بشأنه. ونسعى إلى اتخاذ الإجراء بشأن البلاغات خلال 24 ساعة.
• يجوز لنا مراجعة أي محتوى أو ملف شخصي أو تصفيته أو رفضه أو تقييده أو إزالته، وإيقاف أي ملف أو إزالته، متى رأينا بشكل معقول أنه يخالف هذه الشروط أو القانون، أو يعرّض أي شخص للخطر، أو يعرّضنا أو يعرّض غيرنا لضرر قانوني أو غيره. وسنخبرك بالإجراء الذي اتخذناه متى سمحت اعتبارات السلامة بذلك.
• عندما تبلغ عن شخص، يجوز لنا مراجعة ملفه والرسائل ذات الصلة.
• لسنا ملزمين بمراقبة الخدمة، ولسنا مسؤولين عما ينشره الأعضاء أو يفعلونه، لكننا نتخذ الإجراء بشأن ما نرصده وما تبلغنا به.
• يجوز لنا الاحتفاظ بالمعلومات ومشاركتها متى اقتضى القانون ذلك أو لحماية سلامة أي شخص، وفق ما توضحه سياسة الخصوصية.

6ميزات الخصوصية

يقدّم لك تطبيق شباب ميزات للخصوصية، مثل تمويه الصور وأوضاع تُخفي زياراتك أو ملفك. وهذه الميزات تقلّل ما يراه الأعضاء الآخرون، لكنها لا تُخفي هويتك عنا، ولا تمنع أحداً من التعرّف عليك أو التقاط صورة للشاشة أو نقل ما رآه. فشارك فقط ما ترتاح لمشاركته.

7ملفات نديرها نحن، والذكاء الاصطناعي

للترحيب بالأعضاء الجدد والحفاظ على حيوية التطبيق، ندير نحن بعض الملفات الشخصية، وقد تُكتب الرسائل الصادرة عن هذه الملفات بواسطة الذكاء الاصطناعي أو بمساعدته. وعندما تراسل أحد هذه الملفات، قد تُرسَل رسائلك إلى مزوّد الذكاء الاصطناعي الذي نتعامل معه لكتابة الردود. وتلتزم هذه الملفات بـإرشادات المجتمع نفسها التي يلتزم بها الجميع.

8محتواك

• أنت تملك الصور والرسائل وغيرها من المحتوى الذي تنشره («محتواك»).
• تمنحنا ترخيصاً عالمياً وغير حصري ومجانياً وقابلاً للنقل وللترخيص من الباطن، لاستضافة محتواك وتخزينه ونسخه ومعالجته وتعديله (كتمويهه أو قصّه أو تغيير حجمه) وعرضه ونقله، وذلك فقط لتشغيل الخدمة وتأمينها والإشراف عليها وتحسينها.
• ينتهي هذا الترخيص عند حذف محتواك أو ملفك، باستثناء النسخ التي يلزمنا الاحتفاظ بها بموجب القانون، أو لأغراض السلامة، أو لتطبيق هذه الشروط، أو في النسخ الاحتياطية لمدة محدودة.
• لن نستخدم صورك في الإعلانات أبداً دون إذن صريح منك.
• تتعهد بأنك تملك كل الحقوق اللازمة لمحتواك، وأنه لا يخالف هذه الشروط أو القانون أو حقوق أي شخص آخر.
• إذا أرسلت إلينا ملاحظات أو أفكاراً، يجوز لنا استخدامها بحرية ودون أي مقابل لك.

9العضويات المدفوعة

• تتطلب بعض الميزات عضوية مدفوعة، ويُعرض ما تتضمنه العضوية وسعرها في التطبيق قبل الشراء.
• يُخصم المبلغ من حساب Apple الخاص بك عند تأكيد الشراء.
• تتجدد عضويتك تلقائياً للمدة نفسها (أسبوعياً مثلاً) ما لم توقف التجديد التلقائي قبل 24 ساعة على الأقل من نهاية المدة الحالية. ويُخصم مبلغ التجديد من حسابك خلال الساعات الـ24 السابقة لنهاية المدة الحالية.
• يمكنك إدارة عضويتك أو إلغاؤها من إعدادات حساب Apple. ولا يؤدي حذف التطبيق أو ملفك إلى إلغائها.
• إذا عُرضت عليك فترة تجربة مجانية، فإنها تتحول إلى عضوية مدفوعة عند انتهائها ما لم تلغها قبل 24 ساعة على الأقل من نهايتها. وينتهي أي جزء غير مستخدم من فترة التجربة عند شرائك عضوية.
• تتولى Apple جميع المدفوعات والمبالغ المستردة وفق شروطها، ولا يمكننا رد مبالغ مشتريات App Store بأنفسنا.
• يجوز لنا تغيير الأسعار وما تتضمنه العضويات. وستخبرك Apple بأي زيادة في السعر متى كان ذلك مطلوباً، ويمكنك الإلغاء قبل سريانها.

10الاستخدام العادل للخدمة

يُحظر عليك:

• نسخ البيانات أو المحتوى من الخدمة أو استخراجهما أو جمعهما، بما في ذلك بالوسائل الآلية؛
• استخدام الروبوتات أو البرامج النصية أو الأتمتة، أو إنشاء ملفات شخصية بطريقة آلية؛
• محاولة الهندسة العكسية للتطبيق أو تفكيكه أو التدخل فيه أو في خوادمنا أو أنظمة الأمان لدينا؛
• التحايل على الحظر أو الإزالة أو التمويه أو أي ميزة أخرى للخصوصية أو السلامة؛
• تسجيل صور أعضاء آخرين أو رسائلهم أو ملفاتهم، أو تصويرها، أو مشاركتها خارج تطبيق شباب؛
• استخدام الخدمة لأي غرض تجاري دون إذن كتابي منا؛
• استخدام الخدمة لأي غرض غير مشروع أو ضار أو مضلل.

11تطبيقنا وعلامتنا

• نمنحك ترخيصاً شخصياً وغير حصري وغير قابل للنقل وقابلاً للإلغاء لاستخدام تطبيق شباب على منتجات Apple التي تملكها أو تتحكم فيها، وفق قواعد الاستخدام الواردة في شروط وأحكام خدمات الوسائط من Apple، مع جواز وصول الحسابات الأخرى المرتبطة بك إلى التطبيق واستخدامه عبر المشاركة العائلية أو الشراء بالجملة.
• تطبيق شباب وبرمجياته وتصميمه واسمه وشعاراته ومحتواه (عدا محتواك) ملك لنا أو للجهات المرخِّصة لنا، ولا تمنحك هذه الشروط أي حق فيها سوى هذا الترخيص.

12الخدمات الأخرى

يعتمد تطبيق شباب على شركات أخرى، مثل Apple ومزودي الاستضافة والتقنية لدينا. وعند استخدامك تطبيق شباب، يجب عليك الالتزام بأي شروط لأطراف ثالثة تنطبق عليك، مثل اتفاقية باقة هاتفك المحمول.

13السلامة

لا نجري فحصاً للسوابق الجنائية، ولا نتحقق من هويات الأعضاء بما يتجاوز ما يطلبه التطبيق. وأنت مسؤول عن تعاملاتك مع الأعضاء الآخرين، عبر الإنترنت وعلى أرض الواقع. اقرأ نصائح السلامة في إرشادات المجتمع، ولا ترسل المال أبداً لأي شخص تتعرف عليه في تطبيق شباب.

14إنهاء ملفك

• يمكنك حذف ملفك في أي وقت من إعدادات التطبيق.
• يجوز لنا إيقاف ملفك أو تقييده أو إزالته، بإشعار أو دون إشعار، إذا رأينا بشكل معقول أنك خالفت هذه الشروط أو إرشادات المجتمع، أو إذا كنت تشكّل خطراً أو تعرّضنا أو تعرّض غيرنا لمسؤولية قانونية محتملة، أو إذا اقتضى القانون أو Apple ذلك، أو إذا توقفنا عن تقديم الخدمة (وفي هذه الحالة سنخطرك متى أمكن ذلك عملياً).
• إذا أزلنا ملفك بسبب مخالفة هذه الشروط، فلا يجوز لك إنشاء ملف آخر.
• تبقى البنود 8 و13 ومن 16 إلى 21 سارية بعد انتهاء ملفك.

15التغييرات

• يجوز لنا تغيير الميزات أو إضافتها أو إزالتها، أو تعليق الخدمة أو إيقافها، في أي وقت.
• يجوز لنا تحديث هذه الشروط. وإذا كان التغيير جوهرياً، فسنخبرك به في التطبيق أو في هذه الصفحة قبل 7 أيام على الأقل من سريانه، ما لم يقتضِ القانون أو سلامة أي شخص سريانه قبل ذلك. وإذا لم توافق، فتوقف عن استخدام تطبيق شباب واحذف ملفك وألغِ أي عضوية. واستمرارك في استخدام تطبيق شباب بعد سريان التغيير يعني قبولك له.

16حقوقك بموجب قوانين حماية المستهلك

لا يوجد في هذه الشروط ما يستبعد أو يقيّد أو يغيّر أي حق أو سبيل انتصاف أو ضمان لا يجوز قانوناً استبعاده أو تقييده، ويكون مكفولاً لك بموجب قانون المستهلك الأسترالي أو أي قانون آخر. وحيثما وردت في هذه الشروط عبارة «إلى أقصى حد يسمح به القانون»، فإنها تخضع لهذه الحقوق.

17إخلاء المسؤولية

إلى أقصى حد يسمح به القانون:

• تُقدَّم الخدمة «كما هي» و«حسب توفرها»، دون أي ضمانات من أي نوع؛
• لا نتعهد بأن تكون الخدمة متاحة دون انقطاع أو آمنة أو خالية من الأخطاء، ولا بأنك ستتعرف على أحد، ولا نقدّم أي تعهد بشأن هوية أي عضو أو نواياه أو سلوكه؛
• إذا لم يطابق التطبيق أي ضمان سارٍ، يمكنك إخطار Apple، وستردّ لك Apple سعر شراء التطبيق (إن وُجد). ولا تتحمل Apple أي التزام آخر بالضمان فيما يتعلق بالتطبيق، وأي مطالبات أو خسائر أو التزامات أو أضرار أو تكاليف أو نفقات أخرى تنتج عن عدم مطابقة أي ضمان تقع على عاتقنا، مع مراعاة هذه الشروط، وليس على Apple.

18حدود مسؤوليتنا

إلى أقصى حد يسمح به القانون:

• لا نتحمل المسؤولية عن أي خسارة غير مباشرة أو عرضية أو خاصة أو تبعية أو عقابية، ولا عن أي خسارة في الأرباح أو الإيرادات أو البيانات أو الشهرة التجارية أو السمعة؛
• لا نتحمل المسؤولية عن محتوى أي عضو أو طرف ثالث أو سلوكه، داخل الخدمة أو خارجها، بما في ذلك أي خسارة تنتج عن مقابلة الأعضاء الآخرين أو التعامل معهم؛
• يقتصر إجمالي مسؤوليتنا تجاهك عن جميع المطالبات المتعلقة بالخدمة على ما دُفع مقابل استخدامك للخدمة خلال الأشهر الـ12 السابقة للمطالبة أو 100 دولار أسترالي، أيهما أكبر.

لا تسري هذه الحدود على أي مسؤولية لا يسمح القانون بتقييدها.

19مسؤوليتك تجاهنا

إلى أقصى حد يسمح به القانون، توافق على تعويضنا وتعويض مسؤولينا وموظفينا والمتعاقدين معنا عن أي مطالبات أو خسائر أو أضرار أو تكاليف (بما فيها أتعاب المحاماة المعقولة) بقدر ما تنشأ عن محتواك، أو استخدامك للخدمة، أو مخالفتك لهذه الشروط، أو مخالفتك لأي قانون أو لحقوق أي شخص آخر.

20Apple

تقرّ أنت ونحن بما يلي:

• لا تتحمل Apple أي التزام على الإطلاق بتقديم خدمات الصيانة أو الدعم للتطبيق، فهذه مسؤوليتنا.
• نحن، وليس Apple، المسؤولون عن معالجة أي مطالبات منك أو من أي طرف ثالث تتعلق بالتطبيق أو بحيازتك له أو استخدامك إياه، بما في ذلك مطالبات مسؤولية المنتج، والمطالبات بأن التطبيق لا يستوفي أي متطلب قانوني أو تنظيمي، والمطالبات الناشئة بموجب قوانين حماية المستهلك أو الخصوصية أو ما يماثلها.
• إذا ادّعى طرف ثالث أن التطبيق، أو حيازتك له أو استخدامك إياه، ينتهك حقوق ملكيته الفكرية، فنحن، وليس Apple، المسؤولون وحدنا عن التحقيق في هذه المطالبة والدفاع في مواجهتها وتسويتها وإبراء الذمة منها.
• Apple والشركات التابعة لها أطراف ثالثة مستفيدة من هذه الشروط. وبمجرد قبولك لها، يحق لـApple (ويُعدّ أنها قبلت هذا الحق) إنفاذ هذه الشروط في مواجهتك بصفتها طرفاً ثالثاً مستفيداً.

21النزاعات والقانون الحاكم

• إذا واجهت مشكلة، فتواصل معنا أولاً، وسنحاول حلها معك خلال 30 يوماً.
• تخضع هذه الشروط لقوانين ولاية فكتوريا في أستراليا. وتخضع أنت ونحن للاختصاص الحصري لمحاكم ولاية فكتوريا والمحاكم المختصة بنظر الطعون في أحكامها، مع مراعاة أي قوانين إلزامية لحماية المستهلك في بلد إقامتك.
• عدم إنفاذنا لأي جزء من هذه الشروط لا يعني تنازلنا عنه. وإذا تبيّن أن أي جزء منها باطل أو غير قابل للتنفيذ، فيُقيَّد بالقدر اللازم لجعله صحيحاً وقابلاً للتنفيذ أو يُحذف، وتبقى بقية الشروط سارية.
• يجوز لنا نقل هذه الشروط إلى شركة تستحوذ على تطبيق شباب أو على أصوله، بشرط ألا تنتقص حقوقك، ولا يجوز لك نقلها.
• لا نتحمل المسؤولية عن أي تأخير أو إخفاق ينتج عن أحداث خارجة عن سيطرتنا المعقولة.
• تتوفر هذه الشروط باللغتين العربية والإنجليزية، وإذا اختلفت النسختان تُعتمد النسخة الإنجليزية إلى الحد الذي يسمح به القانون.

1About these Terms

These Terms of Service ("Terms") are an agreement between you and MIDBRA.IN PTY LTD, trading as MEOW Labs ("Shabab", "we", "us" or "our"), an Australian company based in Melbourne, Victoria. They apply to the Shabab app, our website and everything we offer through them (the "Service").

By creating a profile or using the Service, you agree to these Terms, our Community Guidelines and our Privacy Policy, which together are the whole agreement between you and us. If you don't agree, don't use Shabab.

These Terms are between you and us only, not with Apple Inc. We, not Apple, are solely responsible for Shabab and its content.

2Who can use Shabab

Shabab is a social app built for men aged 18 and over. To use it, you must:

• be at least 18 years old and able to enter a binding contract;
• use your own real face in your profile photo;
• have only one profile, and not have had a profile removed by us before;
• not be located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated a "terrorist supporting" country, and not be listed on any U.S. Government list of prohibited or restricted parties;
• follow every law that applies to you, including the laws of the Kingdom of Saudi Arabia while you are there.

We may ask you to confirm your age, or that a photo really is you, and we may refuse, pause or remove any profile that doesn't meet these requirements.

By using Shabab, you represent and warrant that you meet all of these requirements.

3Your profile

• Everything in your profile must be true and must be yours.
• You are responsible for everything that happens on your profile, and for keeping your device and Apple Account secure.
• Shabab doesn't ask for an email address or phone number, so your profile is tied to the device you use. If you delete the app, or reset or lose your device, you may lose your profile, and we may not be able to restore it.
• You may not sell, transfer or share your profile.

4Zero tolerance

Shabab has zero tolerance for objectionable content and abusive members. You must follow our Community Guidelines at all times. Among other things, they ban nudity and sexual content, sexual requests, harassment, hate, threats, scams, illegal goods and anything involving a person under 18. Breaking them can lead to your content or profile being removed without notice.

5Reporting, blocking and moderation

• You can report any profile or chat with Report, and block anyone with Block. Reports are confidential: we never tell a member who reported him.
• We may use automated tools and human review to filter, find and act on content that breaks these Terms. We aim to act on reports within 24 hours.
• We may review, filter, refuse, restrict or remove any content or profile, and pause or remove any profile, when we reasonably believe it breaks these Terms or the law, puts anyone at risk, or exposes us or others to legal or other harm. Where safety allows, we'll tell you what we did.
• When you report someone, we may review his profile and the messages involved.
• We don't have to monitor the Service and we aren't responsible for what members post or do, but we act on what we find and what you report.
• We may keep and share information when the law requires it, or to protect someone's safety, as our Privacy Policy explains.

6Privacy features

Shabab gives you privacy features, such as photo pixelation and modes that hide your visits or your profile. They reduce what other members can see. They don't hide who you are from us, and they can't stop someone from recognising you, taking a screenshot or repeating what they've seen. Only share what you are comfortable sharing.

7Profiles run by Shabab, and AI

To welcome new members and keep Shabab lively, some profiles are run by Shabab, and messages from those profiles may be written by, or with the help of, artificial intelligence. When you message one of these profiles, your messages may be sent to our AI provider to write the replies. These profiles follow the same Community Guidelines as everyone else.

8Your content

• You own the photos, messages and other content you post ("your content").
• You give us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, copy, process, adapt (for example pixelate, crop or resize), display and transmit your content, only to operate, secure, moderate and improve the Service.
• This licence ends when your content or profile is deleted, except for copies we must keep by law, for safety, to enforce these Terms, or in backups for a limited time.
• We will never use your photos in advertising without your clear permission.
• You promise that you have every right your content needs, and that it doesn't break these Terms, the law or anyone else's rights.
• If you send us feedback or ideas, we may use them freely and without paying you.

9Paid memberships

• Some features need a paid membership. What it includes and its price are shown in the app before you buy.
• Payment is charged to your Apple Account when you confirm the purchase.
• Your membership renews automatically for the same period (for example, every week) unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
• You can manage or cancel your membership in your Apple Account settings. Deleting the app or your profile does not cancel it.
• If you're offered a free trial, it becomes a paid membership when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a membership.
• Apple handles all payments and refunds under its own terms. We can't refund App Store purchases ourselves.
• We may change prices and what memberships include. Apple will tell you about a price increase where that's required, and you can cancel before it applies.

10Using the Service fairly

You must not:

• copy, scrape, harvest or collect data or content from the Service, including by automated means;
• use bots, scripts or automation, or create profiles automatically;
• try to reverse engineer, decompile or interfere with the app, our servers or our security;
• get around a block, a removal, pixelation or any other privacy or safety feature;
• record, screenshot or share another member's photos, messages or profile outside Shabab;
• use the Service for any commercial purpose without our written permission;
• use the Service for anything unlawful, harmful or misleading.

11Our app and brand

• We give you a personal, non-exclusive, non-transferable and revocable licence to use the Shabab app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that other accounts associated with you through Family Sharing or volume purchasing may also access and use it.
• Shabab, its software, design, name, logos and content (other than your content) belong to us or our licensors. These Terms give you no right to them other than this licence.

12Other services

Shabab relies on other companies, such as Apple and our hosting and technology providers. When you use Shabab, you must follow any third-party terms that apply to you, such as your mobile phone plan.

13Safety

We don't run criminal background checks, and we don't verify members' identities beyond what the app asks for. You are responsible for your dealings with other members, online and in person. Read the safety tips in our Community Guidelines, and never send money to anyone you meet on Shabab.

14Ending your profile

• You can delete your profile at any time in the app's settings.
• We may pause, restrict or remove your profile, with or without notice, if we reasonably believe you have broken these Terms or the Community Guidelines, if you create risk or possible legal exposure for us or others, if the law or Apple requires it, or if we stop offering the Service (in that case we'll give you notice where practical).
• If we remove your profile for breaking these Terms, you may not create another one.
• Sections 8, 13 and 16 to 21 continue to apply after your profile ends.

15Changes

• We may change, add or remove features, or suspend or stop the Service, at any time.
• We may update these Terms. If a change is significant, we'll tell you in the app or on this page at least 7 days before it applies, unless the law or someone's safety needs it sooner. If you don't agree, stop using Shabab, delete your profile and cancel any membership. If you keep using Shabab after a change applies, you accept it.

16Your rights under consumer law

Nothing in these Terms excludes, restricts or changes any right, remedy or guarantee you have under the Australian Consumer Law, or under any other law, that can't lawfully be excluded or limited. Wherever these Terms say "to the maximum extent permitted by law", they are subject to those rights.

17Disclaimers

To the maximum extent permitted by law:

• the Service is provided "as is" and "as available", without warranties of any kind;
• we don't promise that the Service will be uninterrupted, secure or error-free, or that you'll meet anyone, and we make no promise about any member's identity, intentions or conduct;
• if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to any warranty are our responsibility, subject to these Terms, and not Apple's.

18Limits on our liability

To the maximum extent permitted by law:

• we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, data, goodwill or reputation;
• we are not liable for the content or conduct of any member or third party, on or off the Service, including any loss from meeting or dealing with other members;
• our total liability to you for all claims connected with the Service is limited to the greater of the amount paid for your use of the Service in the 12 months before the claim, or AUD 100.

These limits don't apply to any liability that the law doesn't allow us to limit.

19Your responsibility to us

To the maximum extent permitted by law, you agree to compensate us, our officers, employees and contractors for any claims, losses, damages and costs (including reasonable legal costs) to the extent they arise from your content, your use of the Service, your breach of these Terms, or your breach of any law or of anyone else's rights.

20Apple

You and we acknowledge that:

• Apple has no obligation at all to provide maintenance or support for the app. That is our responsibility.
• We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app, or your possession or use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21Disputes and governing law

• If you have a problem, contact us first. We'll try to resolve it with you within 30 days.
• These Terms are governed by the laws of Victoria, Australia. You and we submit to the exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them, subject to any mandatory consumer law where you live.
• If we don't enforce part of these Terms, we haven't waived it. If any part is found invalid or unenforceable, it is read down or removed, and the rest stays in force.
• We may transfer these Terms to a company that takes over Shabab or its assets, as long as your rights aren't reduced. You may not transfer them.
• We are not liable for any delay or failure caused by events beyond our reasonable control.
• These Terms are available in Arabic and English. If the two versions differ, the English version applies to the extent permitted by law.
